2. New commercial construction does require heat pump water heating
This is the reverse of the residential position and it surprises people. Washington removed the heat pump water heater mandate from the residential code before it took effect on 15 March 2024, so a homeowner can replace a gas tank with a gas tank. But new multifamily and commercial construction does require heat pump water heating under the 2021 Washington commercial energy code, with a like for like fuel replacement allowance for a single fuel fired unit. If you are planning a build or a major tenant improvement, that is a design decision, not a fixture decision.
The 2024 code cycle is scheduled for final adoption on 20 November 2026 with an effective date of 3 May 2027, so anything designed into 2027 should be rechecked.
3. Permits and the jurisdiction question
In the City of Bothell, permits come from the City of Bothell through the regional MyBuildingPermit.com portal. In unincorporated Snohomish County, including Bothell East, Bothell West, Maltby and Clearview, it is Snohomish County Planning and Development Services. Public Health Seattle and King County issues plumbing and gas permits only for Seattle, Clyde Hill and unincorporated King County, so it does not cover Bothell at all. Any side sewer work requires a permit from the public works director under BMC 18.03.340, and it is unlawful to backfill without inspection under 18.03.370, with 24 hours notice required.
